Changes to the Building Act, which will take effect from September 2026, will have a real impact on the way fences are designed and installed. The new regulations affect both entrance gates, wickets, as well as security elements for fences. For investors, this means that conscious planning is required - ideally today to avoid costly rework in the future.
New regulations for gates and wickets - safety first
One of the most important changes is prohibition on gates and wickets opening beyond the plot boundary. From 2026:
- entry gates will not be allowed to open onto the pavement, street or public road,
- wickets must also open inwards into the property.
This is a response to the real dangers in public spaces - especially for pedestrians, children and cyclists. In practice, this means that solutions that are still popular today will be unlawful in new developments.

Prohibited fencing elements - higher safety standard
The amendment to the Construction Law also introduces stricter requirements for the construction of fences. From 2026:
barbed wire, sharp spikes and other hazardous terminations will not be allowed to be below 2.2 m from ground level,
Previously, the permitted height was 1.8 m,
exceptions are only provided for facilities with a special security regime (e.g. military, prisons).
For private and corporate properties, this means using secure, certified fencing systems, such as:
panel fences,
composite fences,
concrete and gabion fences.

Accessibility of wickets - new requirements from 2026
Another important change is accessibility requirements. New wickets in investments made after 2026 must:
- have minimum 90 cm passage width,
- enable people with reduced mobility to move around comfortably,
- be free of obstacles to entry (thresholds, sharp edges).
This is particularly important in the case of:
- housing estates,
- service and company buildings,
- public facilities.
When designing a fence, it is therefore worth thinking not only about aesthetics, but also about functionality and future legal requirements.

👉 the new regulations will only apply to new developments and to the upgrading of existing fences.
